Term of Use

1. Acceptance of Terms of Use. By accessing or using the Site, including accessing or using any online services or information available through the Site, you accept and agree to these Terms of Use, the Privacy Statement, the Player Privacy Policy (applicable to PlayNow.com and PlayNow.com mobile), and any Other Terms applicable to a particular Site. Your continued use of the Site constitutes your acceptance of the Terms in effect at the time of your use of the Site. Please read the Terms carefully before using the Site.

2. Definitions. In these Terms of Use, unless the context clearly states otherwise:

(a) “applicable law” includes applicable statutes, regulations, judicial precedents, board orders, and directives of any applicable governmental or regulatory authority;

(b) “ILC” means the Interprovincial Lottery Corporation;

(c) “Gambling Documents” means the rules and regulations applicable to any lottery scheme offered by the ILC, however described, including the player agreement, rules and regulations, game provisions, and playing rules established by the ILC and posted at https://www.canadianlotto.ca;

(d) “Other Terms” means the notices, agreements, rules, regulations, and other legal provisions applicable to the Site you access or use;

(e) “person” includes an individual, corporation, partnership, joint venture, association, trust, unincorporated organization, society, and all other legal entities recognized by applicable law;

(f) “Site” means the various websites operated by the ILC that provide information, and in some cases services;

(g) “Terms” means collectively these Terms of Use, the Privacy Statement, the Player Privacy Policy, and Other Terms.

(h) “Terms of Use” means these Terms of Use.

(i) "You" includes you and any other person on whose behalf you accept any of the Terms of Use.

3. Interpretation. Unless the context requires otherwise, words referring to the singular include the plural and vice versa. Terms relating to BCLC's discretion or authorization are at the sole, absolute and unfettered discretion of ILC, without any requirement to act reasonably or to provide reasons. Where the words "including", "including", "including" or any variation of "including" are used, they shall be deemed to be followed by the words "without limitation".

4. Gambling Terms. Details of the gambling offered by ILC are set out in the applicable Gambling Documents. In the event of any conflict between the Terms of Use and the Gambling Documents, the provisions of the Gambling Documents shall apply.

5. Changes to the Site Canadianlotto.ca may, in its sole discretion, without prior notice and without liability, a) change, suspend or discontinue any part of the Site including any Terms, and b) remove or change any content or functionality of the Site. Canadianlotto.ca further reserves the right to take any action with respect to the Site necessary to comply with applicable law.

6. Termination Canadianlotto.ca may at any time, with or without notice, without liability, and for any reason deny you access to the Site and terminate or suspend your license to use the Site. If Canadianlotto.ca terminates or suspends your license to use the Site, the Terms will remain in effect with respect to your use of the Site prior to such termination or suspension.

7. Ownership and Intellectual Property. Canadianlotto.ca grants you a revocable, personal, limited, non-sublicensable, non-transferable, and non-exclusive license to access and use the Site, as permitted under the Terms, subject to and conditioned upon your continued compliance with all Terms. All right, title, and interest, including all intellectual property rights, in the Site, including the content and Canadianlotto.ca trademarks therein, are and shall remain the property of Canadianlotto.ca. Without limiting the generality of the foregoing, nothing contained in these Terms of Use or on the Site shall be construed as granting, by implication, estoppel, or otherwise, any license or permission or other right to use Canadianlotto.ca content or trademarks. Unauthorized use of the Site content or Canadianlotto.ca trademarks is strictly prohibited. Nothing in these Terms of Use shall be construed as granting any right to use the Site for any commercial or other non-personal purpose.

8. Unacceptable Use. You shall not:

a. use the Site to violate any applicable law or the legal rights of any person;

b. interfere in any way with the proper functioning of the Site;

c. use the Site to transmit any virus, Trojan horse, worm, or other software, script, or code the effect or purpose of which is to permit unauthorized access to, or to alter, disable, encrypt, delete, or damage, any computer, system, software, or data;

d. decrypt, decompile, disassemble, or reverse engineer the Site or any software or system used to provide it;

e. access or use any part of the Site that is not (expressly or impliedly) intended for your use;
